The Dutch gaming authority, known as Kansspelautoriteit (KSA), has recently announced its plans to enhance the duty of care in gaming halls throughout the Netherlands. This decision comes after a thorough inspection conducted in December 2023 and January 2024, where KSA inspectors visited 20 gaming facilities to evaluate the implementation of duty of care measures required by the Remote Gambling Act (KOA Act).
While most gaming halls have shown efforts to comply with the duty of care regulations, there are certain areas that require improvement based on the findings of the inspections. The KOA Act mandates that gaming halls must take steps to prevent and minimize gambling addiction. Despite having good intentions and policies in place, there is a need to fine-tune the practical application of these measures.
One key observation from the inspections was that gaming halls are generally aware of the personal circumstances and gambling habits of regular players. However, there is a need for more proactive intervention in terms of directly engaging with players, identifying warning signs, and implementing necessary interventions.
During the inspections, it was noted that while gaming halls acknowledge the issue of long playing times as a cause for concern, the methods for monitoring this aspect were not always clearly defined. Moreover, the absence of a maximum playing time, especially in arcades that operate round the clock, poses a significant challenge as it lacks a natural stopping point for players.
Furthermore, the practice of allowing playing on multiple machines and reserving gaming machines, although not prohibited, can contribute to excessive gambling behavior. Several gaming halls also fell short in monitoring other signs of problematic gambling, such as frequent and lengthy visits and a high number of debit card transactions.
As a response to the findings, the KSA has sent letters to each visited arcade outlining specific areas that need improvement. Additionally, the KSA has announced its intention to issue more detailed guidance to all license holders later this year, focusing on enhancing duty of care in gaming halls. This guidance will be accompanied by stricter monitoring to ensure compliance with the regulations.
The KSA’s efforts to bolster oversight in the Dutch gaming industry are part of a larger initiative to improve regulation in preparation for significant market changes starting from October 1. By raising the standards of care in gaming halls, the KSA aims to create safer gambling environments and protect players from harm. The upcoming guidance and enhanced monitoring are crucial steps towards achieving these goals.
